Terms & Conditions

These Terms and Conditions (“Agreement”) constitute a legally binding agreement between you (“Customer”) and P&H Automotive (“Company,” “we,” or “us”) governing the use of our website and the provision of automotive repair and maintenance services (“Services”). By accessing our website, scheduling an appointment, or utilizing our Services, you agree to be bound by the terms of this Agreement.

 

 

 

1. Scope of Services

 

 

1.1 The Company provides automotive diagnostic, repair, and maintenance services as advertised on our website and/or premises.

1.2 All Services are performed subject to the availability of parts, labor, and scheduling.

1.3 Estimates are provided based upon preliminary inspection and information supplied by the Customer. The final cost may vary if additional labor, parts, or services are required.

 

 

 

2. Payment Terms

 

 

2.1 Payment is due in full upon completion of Services unless otherwise agreed in writing.

2.2 The Company accepts Cash, credit and debit cards, check, Apple pay, Cash App, and google Pay.

2.3 Title to any parts installed shall remain with the Company until payment in full is received.

2.4 The Company reserves the right to withhold release of a vehicle until payment is made in full.

 

 

 

3. Estimates and Warranties

 

 

3.1 Estimates are not binding and are subject to revision upon discovery of additional necessary repairs.

3.2 The Company provides limited warranties on labor and parts only to the extent expressly stated on the invoice.

3.3 No warranty applies to:

 

  • Customer-supplied parts;

  • Used or aftermarket parts where no manufacturer warranty is provided;

  • Damage caused by misuse, neglect, accidents, modifications, or failure to maintain the vehicle.

    3.4 Any warranty claims must be presented in writing within the warranty period specified.

 

 

 

 

4. Customer Obligations

 

 

4.1 The Customer shall provide accurate information regarding the vehicle, including known defects, modifications, or prior repairs.

4.2 The Customer shall remove all personal property from the vehicle prior to service. The Company is not liable for loss of or damage to personal belongings left in vehicles.

4.3 Vehicles must be retrieved within 30 days following completion of Services. The Company reserves the right to assess reasonable storage fees thereafter.

 

 

 

5. Limitation of Liability

 

 

5.1 To the fullest extent permitted by law, the Company shall not be liable for:

 

  • Incidental or consequential damages, including but not limited to loss of use, loss of income, or diminished vehicle value;

  • Pre-existing mechanical conditions or latent defects;

  • Failures or damages arising after completion of Services unrelated to the work performed.

    5.2 In no event shall the Company’s total liability exceed the amount actually paid by the Customer for the specific Services giving rise to the claim.

 

 

 

 

6. Website Use

 

 

6.1 The information provided on this website is for general informational purposes only and does not constitute a guarantee, representation, or warranty of any kind.

6.2 The Company retains all rights, title, and interest in the website and its contents. Unauthorized use, reproduction, or distribution is strictly prohibited.

 

 

 

7. Cancellations and Rescheduling

 

 

7.1 Customers must provide at least 24 hours notice to cancel or reschedule an appointment.

7.2 The Company reserves the right to charge a cancellation fee for missed or late cancellations.

 

 

 

8. Governing Law and Jurisdiction

 

 

8.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Oregon.

8.2 Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Marion county, OR.

 

 

 

9. Amendments

 

 

9.1 The Company reserves the right to amend or update these Terms and Conditions at any time without prior notice.

9.2 The updated Agreement shall become effective upon posting to the Company’s website
